First of all, the Constitution pertains only to government and limits it's powers. The Due Process Clause falls under the 5th amendment to the Constitution and says that government shall not deny any citizen of his or her due process of law rights. Government shall not deny. That is important because it means that no private person can possibly deny another citizen of his due process of law. The 5th amendment applies only to the federal government while the 14th amendment guarantees the citizen that state and local governments cannot violate his/her due process rights under the law.
